Teak - Terms of Trade
1.Seller
The seller is Laxdale Teak, Laxdale, Gelston, Castle Douglas,
DG7 1SQ
2. Validity
These terms of trade govern the sale and supply of goods by
Laxdale Teak to you. Laxdale Teak may amend these terms from time to
time.
3. Laxdale
Teak's Contract With You
No contract shall exist between you and Laxdale Teak until Laxdale Teak
has sent you an email confirming receipt and acceptance of
your order. Laxdale Teak is entitled to withdraw from any contract
in the case of obvious errors or inaccuracies regarding the
goods or the order appearing on Laxdale Teak's site or for unavailability
(see 3. below). Laxdale Teak reserves the right to place restrictions
on the volume of any goods ordered.
4. Pricing
and Availability
The prices and availability of the goods are specified on
the Laxdale Teak site. Such information is subject to change without
notice. Each price, as displayed, is inclusive of VAT (at
the standard UK rate) and delivery. In the unlikely event
that the goods are unavailable, or that Laxdale Teak needs to vary
the price due to supplier price increases, tax changes or
site errors for example, following confirmation of your order
Laxdale Teak shall send you a notification by email and allow you
the opportunity to cancel your order if Laxdale Teak has not done
so itself.
5. Delivery
of Goods
Laxdale Teak shall deliver the goods ordered to the delivery address
which you supply. All delivery times quoted on the Laxdale Teak
site are estimates only based on availability, normal processing
and delivery time. Laxdale Teak may deliver items in an order separately.
Your credit card will be debited on despatch of your order.
Title to the goods will pass to you on payment in full. Risk
will pass to you on delivery.
6. Laxdale
Teak Guarantee and Returns Policy
If you are dissatisfied with your order on delivery it will
be replaced as soon as possible or a full refund will be made.
Laxdale Teak shall use reasonable efforts to replace damaged or
defective goods but if replacement is not possible, or if
an order is cancelled for any other reason under these Terms,
Laxdale Teak's only obligation is to refund the full amount paid
by you. This does not affect your statutory rights.
In the
unlikely event that there is a structural failure or design
fault Laxdale Teak will replace on a like-for-like basis or refund
your money in full subject to sight of the original invoice.
Since
all timbers respond to the environment in which they are kept,
some minor splitting of the end grain may occur eg. on the
ends of chair arms, but this is a natural occurrence during
the weathering process and will in no way affect quality or
use.
7. Laxdale
Teak Delivery Schedule
Delivery will normally be within 7 working days from time
of order. All items will arrive in strong cardboard packaging,
and all items are in a ready to use state.
8. Governing
Law and Jurisdiction
Contracts between you and Laxdale Teak shall be governed by Scottish
Law and all disputes shall be submitted to the non-exclusive
jurisdiction of the Scottish courts.
9. Invalidity
of Terms and Conditions
If for any reason part of these terms and conditions is unenforceable,
the validity of the remaining terms and conditions shall not
be affected.
NOTE:
Automatic confirmation of receipt of your Order does not constitute
a Contract between us. A Contract for the Sale of Goods shall
only arise on the despatch of the Goods to you.
